Key Terms Summary


By submitting a work order, you agree to the following:


Staffing Requests – B.R.E.S. will make every effort to accommodate short-notice staffing requests; however, the more advance notice provided, the greater the likelihood of fully staffing an event.


Minimum Hours – Each staff member must work at least 3 hours, and at least 80% of any scheduled shift longer than 3 hours.


Payment – Invoices are due within 30 days. A 3% late fee applies to overdue balances.


Cancellation – You may cancel an event at any time with no cancellation fee.


Hiring Restrictions – Clients may not hire B.R.E.S. staff directly for one year after service, unless approved with a $7,500 recruitment fee.


Insurance & Safety – Both B.R.E.S. and Client must maintain liability insurance of at least $1,000,000. Client must provide a safe workplace and a meal for any Staff member working five (5) hours or more.


Liability – B.R.E.S.’s liability is limited to the total fees paid for services.

These Terms of Service (“Terms”) govern the provision of event staffing services by Effie Tubwater, LLC, doing business as Blue Ridge Event Staffing (“B.R.E.S.”) to corporate and organizational clients (“Client”). By submitting a work order form through our website, Client acknowledges and agrees to these Terms.


1. Scope of Services


  • B.R.E.S. recruits, screens, and provides qualified event staff (“Staff”) for Client-hosted events at locations Client owns, leases, or has permission to use.


  • Staffing needs and roles may vary by event.


  • B.R.E.S. will make every effort to accommodate short-notice staffing requests; however, the more advance notice provided, the greater the likelihood of fully staffing an event.


2. Payment Terms


  • Payment is due within 30 days of the invoice date.


  • A 3% late fee applies to any unpaid invoice after 30 days.


  • In case of a billing dispute, Client must pay the undisputed portion while the matter is resolved.


3. Minimum Staffing Commitment


  • Each Staff member must work a minimum of three (3) hours per event unless otherwise agreed in writing.


  • Client agrees not to release Staff before completing three hours or 80% of the scheduled shift, whichever is greater.


4. B.R.E.S. Responsibilities


B.R.E.S. will:


  • Recruit, screen, and assign event Staff.


  • Pay Staff wages.


  • Maintain general liability insurance of at least $1,000,000 aggregate.


  • Ensure alcohol-serving Staff are 21+ and possess valid “Safe Server” certification.


  • Ensure confidentiality agreements are signed if requested by Client.


5. Client Responsibilities


Client will:


  • Supervise Staff and remain responsible for its business operations.


  • Provide a safe workplace and appropriate job information.


  • Maintain general liability insurance of at least $1,000,000 aggregate.


  • Provide legally required breaks and a meal for any Staff member working five (5) hours or more.


  • Not assign Staff to drive vehicles or operate equipment without B.R.E.S. consent.


6. Staff Recruitment & Hiring Restrictions


  • Client may not employ or contract directly with any B.R.E.S. Staff during the event or for one year afterward, unless:


1. The Staff member has worked 400+ hours for Client through B.R.E.S.;


2. The Staff member previously worked for Client; or


3. B.R.E.S. consents and Client pays a $7,500 recruitment fee.


  • Client must notify B.R.E.S. if hiring a Staff member.


  • Client may disapprove of any Staff assigned.


7. Event Cancellation Policy


  • Client may cancel an event at any time with no cancellation fee.


8. Confidentiality


Both B.R.E.S. and Client agree to keep proprietary or sensitive information confidential and not disclose it to third parties.


9. Indemnification


  • Client will indemnify B.R.E.S. against claims or losses arising from Client’s breach or misconduct.


  • B.R.E.S. will indemnify Client against claims or losses arising from B.R.E.S.’s breach or misconduct.


  • The indemnifying party must provide notice of claims within 30 days.


10. Limitation of Liability


Neither party is liable for indirect or consequential damages (e.g., lost profits). B.R.E.S.’s total liability will not exceed the total fees paid by Client for the services.


11. Governing Law & Dispute Resolution


  • These Terms are governed by the laws of North Carolina.


  • Disputes will be resolved through binding arbitration in Buncombe County, NC, administered by the American Arbitration Association if the parties cannot mutually agree on an arbitrator.


  • Costs of arbitration will be shared equally.


  • This clause does not apply to non-payment claims by B.R.E.S.


12. Force Majeure


Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, government orders, labor disputes).


13. Independent Contractor


B.R.E.S. acts as an independent contractor and not as Client’s employee or agent.


14. Entire Agreement


These Terms, together with any submitted work order form, represent the entire agreement between B.R.E.S. and Client. Failure to enforce a provision does not waive future enforcement.


15. Acceptance of Terms


By submitting a work order form through our website, Client confirms that they have read, understood, and agreed to these Terms of Service.
